• Eliminates fees for expungement or sealing of records when arrests result in release without charging, or when charges result in acquittal, dismissal, or conviction that was reversed or vacated, except for minor traffic violations.

• Replaces the county fee waiver pilot program (limited to counties with 3,000,000+ inhabitants and set to expire January 1, 2022) with a permanent statewide fee waiver for eligible records.

• Maintains existing procedural requirements for expungement and sealing petitions, including drug testing requirements for certain felony records and waiting periods based on offense type.

• Preserves exceptions preventing expungement or sealing of records for sexual offenses against minors, DUI offenses, and certain violent crimes, with limited exceptions for misdemeanor driving violations for offenders under 25.
