IL HB2426

Amends the Mental Health and Developmental Disabilities Code to require facilities to inform recipients of their right to request transfer to a different Department facility under Section 3-908 when notifying them of their rights upon commencement of services.

Establishes a formal transfer request process allowing recipients, their attorneys, guardians, and responsible relatives to submit written applications to transfer to another Department facility, with the Department providing the application form upon request.

Requires the facility director to schedule a hearing within 7 days of a transfer application, conducted by a utilization review committee, where the recipient must prove the destination facility is less restrictive and more clinically appropriate without threatening safety.

Prohibits recipients with a primary diagnosis of developmental disability from requesting transfers and imposes a 180-day waiting period before resubmitting an application if a transfer request is denied or refused.

Requires the transferring facility to complete approved transfers within 30 days and to notify the recipient in writing with an estimated timeframe if the transfer cannot be executed due to lack of available beds.
