HB2851 - Uniform Faithful Presidential Electors Act

• Creates the Uniform Faithful Presidential Electors Act, requiring political parties and unaffiliated presidential candidates to submit both an elector nominee and an alternate elector nominee to the Secretary of State for each elector position.

• Requires all elector and alternate elector nominees to execute pledges committing to vote for the President and Vice President nominees of the party or unaffiliated candidate that nominated them.

• Authorizes the Secretary of State to reject and not count ballots from electors who fail to mark both ballots or mark them in violation of their pledges, with such violations creating vacant positions to be filled by alternate electors.

• Establishes a process for filling vacant elector positions during the voting meeting, prioritizing the designated alternate elector, then drawing by lot from other available alternates of the same party, then appointing qualified individuals through nomination and plurality vote of remaining electors.

• Makes conforming amendments to the Illinois Election Code (10 ILCS 5/21-1 through 21-4) to incorporate alternate electors into existing elector selection and certification procedures, and repeals Section 21-5; effective immediately.
