IL HB3035

Amends the Code of Civil Procedure Section 11-110 to restrict when units of local government may seek damages related to temporary restraining orders or preliminary injunctions.

Prohibits units of local government from seeking damages in connection with a temporary restraining order or preliminary injunction based upon a constitutional challenge to a tax.

Requires courts to award the respondent reasonable attorney's fees and costs if a local government files a petition for damages in violation of this prohibition.

Takes effect immediately upon becoming law.
