Increases fines for operating a motor vehicle while using an electronic communication device: from $75 to $120 for a first offense, $100 to $145 for a second offense, $125 to $170 for a third offense, and $150 to $195 for a fourth or subsequent offense.

Establishes aggravated use charge when a violation of the electronic communication device prohibition is involved in a motor vehicle accident resulting in great bodily harm, permanent disability, disfigurement, or death to another person, with the violation as a proximate cause of the injury or death.

Violations of aggravated use constitute a Class A misdemeanor if resulting in great bodily harm, permanent disability, or disfigurement, and a Class 4 felony if resulting in death.

Establishes a minimum fine of $1,000 for violations of the aggravated use provision.

Maintains existing exceptions for law enforcement, emergency vehicle operators, first responders, hands-free devices, emergency reporting, and certain commercial vehicle communication systems.
