HB3090 - Environmental Justice Act

• Creates the Illinois Environmental Justice Advisory Council with 9-15 members (including at least 4 residents from environmental justice neighborhoods) to provide independent advice to the Governor and state agencies on environmental justice policies and actions.

• Requires the Environmental Protection Agency to develop an enforcement strategy prioritizing environmental justice population neighborhoods, compile annual enforcement reports, establish a supplemental environmental project bank, and publish progress reports every 5 years.

• Mandates enhanced environmental impact analysis and public participation for projects located within 1 mile of environmental justice populations (or 5 miles for air-exceeding projects), including multilingual reports and accessible public meetings.

• Directs the EPA to initiate rulemaking within 180 days to establish caps on siting and expansion of Toxics Release Inventory facilities in environmental justice neighborhoods.

• Requires all state agencies to appoint environmental justice coordinators and develop tailored environmental justice policies or strategies within 180 days, with reviews every 5 years, and establishes an Interagency Environmental Justice Working Group to coordinate state resources.
