HB3174 Summary

• Amends the Illinois Enterprise Zone Act to expand "High Impact Business" designations to include replacement of existing electric generation facilities and demolition/removal of facilities regardless of replacement status for wind power projects placed in service on or after July 1, 2009.

• Adds permanent structures and associated transmission lines, substations, and equipment to the definition of wind energy facilities eligible for High Impact Business designation.

• Designates wind energy businesses as eligible for exemptions under Section 5l of the Retailers' Occupation Tax Act.

• Establishes a High Impact Business construction jobs credit beginning January 1, 2021, providing 50% of incremental income tax (or 75% in underserved areas) for construction employees, with a $20,000,000 annual cap under the Blue Collar Jobs Act.

• Requires contractors and subcontractors to maintain certified payroll records for 5 years and file monthly certified payrolls with the Department of Labor and Department of Commerce and Economic Opportunity for High Impact Business construction projects.
