IL HB3221

Amends the Criminal Code of 2012 by adding Section 12-5.03 to create a new crime of reckless endangerment of a first responder or coroner by fentanyl exposure.

A person who unlawfully possesses fentanyl commits this crime if they recklessly perform any act that causes bodily harm to a first responder or coroner through exposure to or contact with fentanyl.

A person also commits this crime when they unlawfully deliver fentanyl to another person that causes bodily harm to a first responder or coroner through exposure to or contact with that fentanyl.

Reckless endangerment of a first responder or coroner by fentanyl exposure is classified as a Class 2 felony.

The act defines "first responder" as emergency medical services personnel, law enforcement officers, or firefighters, and "fentanyl" as any substance containing fentanyl or fentanyl analogs in any form.
