HB3223 Summary

• Creates Article 26A of the School Code establishing comprehensive protections and support services for students who are parents, expectant parents, or victims of domestic or sexual violence

• Requires school districts to adopt policies on inter-district transfers, complaint resolution procedures, and confidentiality protections for affected students by July 1, 2024

• Mandates each school district designate at least one domestic or sexual violence and parenting resource person at each school to connect students to services and coordinate implementation of policies by June 30, 2024

• Allows student victims of domestic or sexual violence to immediately transfer to another school if their continued attendance poses a risk to mental or physical well-being, with full access to extracurricular activities

• Expands suspension and expulsion procedures to allow students to disclose status as parent, expectant parent, or victim of domestic or sexual violence as mitigation factor, and requires documentation of alternative interventions attempted before exclusion
