IL HB3265

Amends Section 8-802.1 of the Code of Civil Procedure to protect confidential communications between sexual assault victims and rape crisis counselors from disclosure in civil or criminal proceedings without written consent.

Expands the definition of "rape crisis organization" to explicitly include rape crisis centers certified by a statewide sexual assault coalition.

Broadens the scope of protected victims to include those who experience aggravated criminal sexual assault, predatory criminal sexual assault of a child, criminal sexual assault, sexual abuse, sexual exploitation of a child, indecent solicitation of a child, and related offenses.

Establishes limited exceptions allowing disclosure without victim consent when failure to disclose would create a clear, imminent risk of serious physical injury or death, with immunity from liability for good faith disclosures.

Makes knowing disclosure of confidential communications in violation of this Act a Class C misdemeanor.
