HB3308 Summary: Telehealth Services

• Individual and group health insurance policies amended, delivered, issued, or renewed after the bill's effective date must cover telehealth services, e-visits, and virtual check-ins at the same rates and with the same cost-sharing as in-person services through January 1, 2028 (mental health and substance use disorder services covered indefinitely).

• Insurance policies cannot require prior in-person visits, proof of hardship, geographic restrictions, separate provider panels, or more stringent prior authorization and documentation requirements for telehealth than for in-person care.

• Reimbursement for telehealth services provided through interactive telecommunications systems by in-network health care professionals must equal the reimbursement rate for equivalent in-person services (inoperative January 1, 2028, except for mental health and substance use disorder services).

• Early intervention providers may deliver services via telehealth consistent with their licensing scope and standards of care, with parents informed of telehealth availability and given final decision-making authority on service delivery method.

• Department of Insurance and Department of Public Health must commission a report by December 31, 2026, analyzing telehealth coverage policies' impact on access, health equity, utilization, and costs.
