IL HB3540

Amends the Election Code to require the State Board of Elections to work with election authorities and the disability community to develop procedures and technologies for accessible vote-by-mail ballots in alternative formats.

Mandates that vote-by-mail ballot options allow voters to cast secret, independent, and verifiable ballots without assistance from another person.

Requires procedures to include an accessible electronic ballot marking tool enabling voters to mark ballots privately and independently.

Directs the State Board and election authorities to implement alternative ballot return methods, including secure email portals, conforming to Web Content Accessibility Guidelines (WCAG) 2.1AA and related accessibility standards.

Requires each election authority to provide fully electronic ballots with both electronic marking and electronic return capabilities for voters with disabilities by January 1, 2023.
