HB3562 Summary

• Increases penalty for unlawful use of weapons from Class 4 felony to Class 3 felony when a person knowingly carries or possesses a pistol, revolver, stun gun, taser, or firearm in a vehicle or concealed on their person (outside permitted locations).

• Changes aggravated unlawful use of a weapon with a firearm to a Class 3 felony (from Class 4) for first offenses by persons 18 years or older when specific factors exist, with mandatory imprisonment of not less than 2 years and not more than 5 years.

• Increases penalty for unlawful possession of firearms from Class A misdemeanor to Class 4 felony for all firearm possession violations (removes prior distinction between handguns and other firearms).

• Maintains exceptions for lawful activities including concealed carry license holders, broken down or properly stored weapons, and persons engaged in authorized hunting, target shooting, or training courses.

• Establishes enhanced penalties for firearm violations committed in schools, public parks, courthouses, public housing, and within 1,000 feet of these locations, ranging from Class 2 to Class 4 felonies depending on weapon type.
