• Creates the Freedom of Association and Right to Assembly Act, prohibiting any unit of government from infringing upon a qualifying entity's freedom of association.

• Defines "qualifying entity" as private sector organizations including corporations, partnerships, unions, religious associations, fraternities, sororities, and charitable organizations.

• Prohibits conditioning government, taxpayer-funded, or student-fee-funded benefits (including scholarships, grants, contracts, and housing) on a qualifying entity surrendering freedom of association rights.

• Prohibits imposing obligations on qualifying entities that they believe would violate state or federal law as a condition of receiving government benefits.

• Allows qualifying entities to assert counterclaims in legal actions alleging government actions violate their freedom of association, with courts authorized to award reasonable attorney's fees to prevailing parties.
