HB3680 - Deployment and Training Leave Protection Act

• Creates the Deployment and Training Leave Protection Act requiring employers to grant leave to law enforcement officers who are active members of the United States Armed Forces, Illinois National Guard, or Reserve Forces for deployment or training purposes.

• Defines eligible employees as full-time Illinois law enforcement officers who are active military members and defines employers as the State, local government units, public colleges/universities, and other public entities with law enforcement authority.

• Requires eligible employees and employers to mutually agree on leave terms and conditions, with employers able to require verification of deployment or training necessity; employers cannot deny leave solely based on the time of year the leave would occur.

• Directs the Department of Labor in consultation with the Department of Veterans' Affairs to adopt rules establishing conditions, procedures, and documentation requirements for requesting and approving deployment and training leave.

• Preempts home rule by prohibiting home rule units from regulating deployment or training leave in a manner more restrictive than state regulation, and preserves any more beneficial rights under federal or state law, collective bargaining agreements, or other existing policies.
