HB3686 Summary

• Allows confiscated weapons transferred to law enforcement agencies to be sold at public auction under the Law Enforcement Disposition of Property Act, in addition to existing options of destruction or transfer to Department of State Police.

• Permits courts to order sale of firearms at public auction when respondents cannot retrieve them after domestic violence order expiration because they cannot be located, fail to respond, or are ineligible to possess firearms.

• Expands the Law Enforcement Disposition of Property Act to explicitly authorize public auction sales of weapons confiscated due to abandonment or illegal possession, provided no legitimate claim is made within 6 months of confiscation.

• Applies similar firearm disposition procedures to both criminal cases (720 ILCS 5/24-6) and domestic violence orders of protection (725 ILCS 5/112A-14 and 750 ILCS 60/214).
