Changes the definition of "small employer" under the Illinois Health Insurance Portability and Accountability Act from employers with an average of at least 2 employees to employers with an average of at least 1 employee during the preceding calendar year.

Lowers the minimum employee requirement on the first day of the plan year from 2 employees to 1 employee for classification as a small employer.

Maintains the upper limit of 50 employees for small employer classification, with all other aggregation rules and provisions remaining unchanged.

Takes effect immediately upon becoming law.
