Group health insurance policies covering more than 25 employees that provide pregnancy-related benefits must include coverage for infertility diagnosis and treatment, including in vitro fertilization, artificial insemination, and related procedures.

Coverage for advanced fertility procedures (in vitro fertilization, gamete intrafallopian tube transfer, zygote intrafallopian tube transfer) requires the individual to have failed less costly infertility treatments and limits coverage to 4 completed oocyte retrievals, with 2 additional retrievals allowed if a live birth results from a previous retrieval.

Fertility medications must receive the same coverage terms as other prescription medications, and fertility services cannot be restricted based on participation by third parties or involve different deductibles, copayments, or waiting periods compared to non-infertility benefits.

Religious institutions and organizations sponsored by religious institutions are exempt from the infertility coverage requirements if the procedures violate their religious and moral teachings.

Redefines "infertility" to include failure to establish or carry a pregnancy after 12 months of unprotected intercourse (6 months if woman is over 35), inability to reproduce without medical intervention, or a physician's findings based on medical history and diagnostic testing.
