Car-Sharing Program Act Summary

• Car-sharing programs must assume liability for bodily injury, property damage, and uninsured/underinsured motorist losses during car-sharing periods in amounts at least 4 times the minimum required under Illinois Vehicle Code Section 7-601.

• Car-sharing programs must maintain motor vehicle liability insurance providing coverage equal to 2 times minimum amounts required by Section 7-601 of the Illinois Vehicle Code for shared-vehicle drivers, either through their own policy or in combination with owner/driver insurance.

• Car-sharing programs must collect and retain records for at least the applicable personal injury statute of limitations, including usage times, pickup/drop-off locations, fees, and revenues, and provide this information to owners, drivers, or insurers upon request for claims investigations.

• Car-sharing agreements must disclose to owners and drivers the program's right to seek indemnification, that personal auto insurance may not cover shared vehicle use, insurance coverage is only active during the car-sharing period, and applicable rates and fees.

• Vehicle owners must verify that shared vehicles have no unrepaired safety recalls before making them available through a car-sharing program, and must remove vehicles from the program if a recall notice is received.
