HB3720 - Drug and Sharps Waste Stewardship Act

• Creates a statewide drug and sharps waste stewardship program administered by the Illinois Environmental Protection Agency, with the State Board of Pharmacy providing guidance and oversight.

• Requires covered entities (manufacturers, distributors, repackagers, trademark owners, or importers of drugs and sharps) to establish and fund stewardship plans for collecting and properly disposing of covered products at no cost to consumers.

• Mandates minimum collection infrastructure of 5 authorized collection sites per county or 1 site per 50,000 people (whichever is greater), with mail-back programs and alternative collection methods required where needed.

• Imposes quarterly administrative fees on covered entities to cover state regulatory costs, with penalties of up to $10,000 per day for violations or $50,000 per day for intentional violations.

• Creates the Drug and Sharps Stewardship Fund and Penalty Account to support program administration; exempts local stewardship ordinances enacted before January 1, 2021, but prevents them from receiving state funds.
