IL HB3851

Permanently waives recovery and recoupment of unemployment benefits received without fault by individuals whose benefit year began on or after March 8, 2020, but before the week following the last week of a COVID-19 disaster period established by gubernatorial proclamation.

Prevents the Director of Employment Security from requesting the Comptroller or Secretary of the Treasury to withhold benefits in cases where permanent waiver of recovery or recoupment applies under the new COVID-19 provision.

Applies to individuals who received benefits during the COVID-19 disaster period and received such benefits without fault on their part, even if recoupment would otherwise be against equity and good conscience.

Takes effect immediately upon becoming law.
