IL HB3906

Amends Illinois School Code Section 14-1.11a to establish when a school district is the "resident district" for student enrollment purposes, including cases involving unknown parent/guardian locations, emancipated minors, and students in state agency custody.

Specifies that when an Illinois public agency has legal guardianship and places a student outside Illinois, the last district providing at least 45 days of educational service remains the resident district until guardianship ends or the student returns to Illinois.

Defines homeless students' resident district as the Illinois district where they enroll for educational services, in accordance with the Stewart B. McKinney Homeless Assistance Act.

Grants the State Superintendent of Education authority to determine if a parent or guardian location is unknown based on district submissions including an affidavit and documentary evidence of at least 4 separate location attempts, with determinations being final but subject to reconsideration if location is later discovered.

Takes effect immediately upon becoming law.
