HB3991 Summary

• Repeals Section 24-1.7 of the Criminal Code of 2012 (armed habitual criminal statute) and Section 5-4.5-95 of the Unified Code of Corrections (general recidivism and habitual criminal provisions).

• Persons convicted under the repealed armed habitual criminal statute or general recidivism provisions before the repeal are ineligible for parole or mandatory supervised release consideration if any conviction was for first degree murder, second degree murder, or any sex offense.

• Makes conforming amendments to the Illinois Vehicle Code regarding school bus driver permits and commercial driver's licenses to remove references to the repealed armed habitual criminal statute.

• Modifies sentence credit provisions to reference the repealed armed habitual criminal statute "before the effective date of this amendatory Act" for sentencing purposes.

• Amends the Code of Criminal Procedure and criminal sentencing statutes to reflect the elimination of these habitual criminal provisions while preserving their application to offenders convicted prior to the repeal date.
