HB4012 - Regulatory Sunrise Review Act

• Creates the Sunrise Review Unit within the Department of Financial and Professional Regulation to evaluate applications for regulating previously unregulated professions or expanding scope of practice for licensed professions.

• Allows professional groups, individuals, or interested parties to submit sunrise applications with 19 specified minimum criteria including evidence of public harm, existing protections, state and federal regulations, and educational requirements.

• Requires the Sunrise Review Unit to complete reviews within 18 months total (12 months to commence, 6 months to prepare final report) and submit findings to the General Assembly with recommendations on whether regulation is necessary.

• Establishes a nonrefundable fee structure for applications, with fees deposited into the General Professions Dedicated Fund to cover Department administration costs.

• Takes effect July 1, 2022.
