HB4123 Summary

• Municipalities may require property owners or occupants to remove nuisance greenery and maintain property between the sidewalk and roadway.

• Property owners or occupants become liable for injuries sustained by persons due to failure to remove nuisance greenery or maintain abutting property.

• If owners or occupants fail to remove nuisance greenery or maintain required property, municipalities may perform removal and collect reasonable costs from the property owner.

• Removal costs become a lien on the underlying parcel in accordance with Section 11-20-15.

• "Nuisance greenery removal" includes cutting weeds or grass, trimming trees or bushes, and removing nuisance bushes or trees.
