HB4186 - Kratom Consumer Protection Act

• Establishes safety and labeling requirements for kratom products and extracts, including adequate directions for safe use and recommended serving sizes.

• Prohibits processors from preparing, distributing, or selling kratom products that are adulterated with dangerous non-kratom substances, contaminated with controlled substances, or contain synthetic alkaloids.

• Restricts kratom products containing 7-hydroxymitragynine levels greater than 2% of alkaloid composition and limits residual solvents in kratom extracts to levels allowed by United States Pharmacopeia (USP) 467.

• Prohibits sale of kratom products to persons under 18 years of age, with violations punishable under the Kratom Control Act.

• Imposes administrative penalties on violating processors of up to $5,000 for first offense and up to $10,000 for subsequent offenses, collected by the Department of Public Health and paid into the Food and Drug Safety Fund; provides retailers a defense if they relied in good faith on manufacturer representations.
