HB4221 - Pregnancy Center Disclosure Act

• Creates the Pregnancy Center Disclosure Act to protect health, safety, and welfare of pregnant women by requiring disclosure notices at unlicensed pregnancy facilities.

• Defines "limited services pregnancy facility" as an unlicensed facility providing pregnancy-related services without licensed medical providers, including those offering ultrasounds, pregnancy tests, prenatal care, or pregnancy counseling.

• Requires facilities to display notices stating "This facility is not licensed as a medical facility by Illinois and has no licensed medical provider who provides or directly supervises the provision of services" on-site (minimum 11x17 inches, 80-point type at entrance and waiting areas) and in all print and digital advertising materials.

• Imposes civil penalties of $500 for first offense and $5,000 for subsequent offenses, enforceable by the Attorney General after providing 30 days notice to cure violations; allows private parties to seek injunctive relief and recover attorney's fees if they prevail.

• Requires notices in other languages in counties where more than 10% of population speaks a non-English language at home, and in the same language as any advertising materials.
