HB4289 Summary

• Requires Illinois Commerce Commission (ICC) prior approval before any property belonging to a public utility providing water or sewer service subject to ICC jurisdiction may be taken or damaged through eminent domain.

• Applies to eminent domain actions commenced after the effective date of this Act; excludes actions already commenced prior to enactment.

• Amends the Illinois Municipal Code (sections 11-124-5 and 11-139-12) and the Eminent Domain Act (section 10-5-10) to add ICC approval requirements for water and sewer utility property.

• Effective immediately upon becoming law.
