• Authorizes governmental and nongovernmental entities, including local health departments and community organizations, to distribute fentanyl test strips to the public to test for fentanyl, fentanyl analogues, or drug adulterants in controlled substances.

• Expands the Overdose Prevention and Harm Reduction Act to allow needle and syringe access programs to provide drug adulterant testing supplies such as reagents, test strips, and quantification instruments as part of harm reduction efforts.

• Amends the Drug Paraphernalia Control Act to exclude equipment, products, or materials designed to analyze or test for fentanyl, fentanyl analogues, or drug adulterants from the definition of drug paraphernalia.

• Provides immunity from prosecution for employees, volunteers, and participants in harm reduction programs who possess needles, syringes, testing supplies, or residual controlled substances obtained from or returned to such programs.

• Takes effect immediately upon becoming law.
