• Long-term care facilities must spend at least 85% of total operating revenue on direct care of residents as part of resident care.

• "Direct care" is defined as care provided by nurses, certified nurse aides, or certified nurse assistants in the facility setting.

• "Resident care" includes direct care, support services (housing, food service, activities), ancillary program services (medical, dental, therapy), and personal grooming programs, but excludes administrative costs, capital costs, rent, and debt service.

• "Total operating revenue" means revenue received by a facility from residents, government payors, or third-party payors for occupancy, resident care, and facility operations.

• The Department of Public Health and Department of Healthcare and Family Services may adopt rules for implementation; the act takes effect immediately upon passage.
