IL HB4379

Amends Section 11-14.1 of the Criminal Code of 2012 regarding solicitation of sexual acts.

Deletes the affirmative defense that allowed defendants to claim they reasonably believed the person was 18 years or older or did not have a severe or profound intellectual disability.

Maintains that solicitation of a sexual act from a person under 18 or with severe or profound intellectual disability remains a Class 4 felony.

Preserves exemptions for persons under 18 engaged in prostitution and those accused whose offense consists exclusively of their own acts of prostitution.
