IL HB4380

Amends the Criminal Code of 2012, Section 11-1.70, regarding defenses to criminal sexual abuse and aggravated criminal sexual abuse involving victims under 17 years of age.

Establishes that a victim's statement claiming to be 17 years of age or over cannot serve independently as a defense to these offenses.

Prohibits the presence of a victim on a social media platform requiring users to be 17 years of age or over from serving independently as a defense.

Prevents attendance in educational activities such as high school trade programs or community college classes that are generally attended by those 17 or older from serving independently as a defense.

Maintains the existing defense that an accused reasonably believed the person to be 17 years of age or over, but limits what factors can support that reasonable belief.
