HB4430 Summary

• Allows pharmacists to initiate, dispense, and administer drugs and conduct laboratory tests, assessments, referrals, and consultations for HIV pre-exposure prophylaxis (PrEP) and post-exposure prophylaxis (PEP) under standing orders from physicians or county/local health department medical directors.

• Permits pharmacists to order clinical laboratory tests in accordance with Section 43.5 of the Pharmacy Practice Act and authorizes clinical laboratories to report test results to pharmacists meeting these requirements.

• Requires insurance policies and managed care plans issued or renewed on or after January 1, 2023 to cover patient care services provided by pharmacists if the same service is covered for physicians, advanced practice registered nurses, or physician assistants and the pharmacist is in the plan's network.

• Mandates Medicaid coverage at 85% of physician reimbursement rates for pharmacist-provided patient care services for hormonal contraceptives, HIV PrEP, and HIV PEP, with pharmacists required to complete ACPE-accredited educational training.

• Requires pharmacists to communicate services provided to patients and their health care providers, maintain confidentiality consistent with state HIV requirements, and provide services in a private setting.
