HB4470 - Equitable Access to Electronic Literature Act

• Requires publishers offering electronic books and digital audiobooks to the public to also license these products to libraries purchasing with public funds on reasonable terms with reasonable technological protections.

• Allows publishers to limit total circulations per license (capped at 100% of retail list price), simultaneous users, and access duration as reasonable licensing terms.

• Prohibits contracts from restricting libraries' ability to loan digital materials using security measures, make preservation copies, use technological protections, or purchase multiple licenses on the same date products become publicly available.

• Classifies violations as unlawful practices under the Consumer Fraud and Deceptive Business Practices Act, with fines of $1,000-$5,000 for first offense and $1,500-$5,000 for subsequent offenses.

• Takes effect January 1, 2023.
