HB4616 Summary: Community Disability Living Wage Act

• Requires the Department of Human Services and Department of Healthcare and Family Services to increase reimbursement rates for community-based providers serving persons with intellectual and developmental disabilities to provide a minimum $3.50 per hour wage increase for front-line personnel effective July 1, 2022.

• Mandates that wages for all other residential non-executive direct care staff (excluding direct support personnel) be set at the U.S. Department of Labor's average wage as defined by departmental rule.

• Applies to residential and day programs, service coordination agencies, ID/DD facilities, MC/DD facilities, and other community-based disability services funded by state or Title XIX federal funds.

• Grants the Departments of Human Services and Healthcare and Family Services emergency rulemaking authority under the Illinois Administrative Procedure Act to expedite implementation of wage increases.

• Effective immediately upon becoming law.
