HB4666 Summary

• Amends the Freedom of Information Act to add information prohibited from disclosure under paragraph (3) of subsection (a) of Section 14 of the Nurse Agency Licensing Act to the list of statutory exemptions.

• Expands the Nurse Agency Licensing Act to define "covenant not to compete" and prohibit nurse agencies from entering into non-compete agreements with nurses and certified nurse aides effective July 1, 2022.

• Increases professional liability insurance requirements for nurse agencies from $500,000 per incident and $1,000,000 aggregate to $1,000,000 per incident and $3,000,000 aggregate, and adds requirement for workers' compensation coverage.

• Requires nurse agencies to submit copies of all contracts with health care facilities to the Department of Labor within 5 business days of execution and prohibits disclosure of these contracts under the Freedom of Information Act.

• Mandates quarterly reporting by nurse agencies to the Department regarding charges to health care facilities, wages paid to employees, and labor-related costs, with the Department publishing average rates by county on its website.

• Prohibits nurse agencies from requiring employees to pay conversion fees, placement fees, or other compensation if hired as permanent employees by health care facilities, and requires payment of 100% of hourly wage rates to employees.
