Amends Section 10-55 of the Illinois Administrative Procedure Act to define "invalidated" for purposes of awarding litigation expenses and attorney's fees.

Defines "invalidated" to mean any court action declaring or rendering an administrative rule unenforceable or without legal effect for any period of time, including temporary restraining orders, preliminary injunctions, permanent injunctions, or final decisions on the merits.

Clarifies that when a court invalidates an administrative rule, the prevailing party is entitled to recover reasonable expenses and attorney's fees from the agency.

Specifies that the changes made by this Act are declarative of existing law.

Takes effect immediately upon becoming law.
