IL HB4726

Creates a new felony offense of illegal electronic monitoring in the Criminal Code of 2012 (Section 26-4.7).

Prohibits knowingly installing, concealing, or placing electronic tracking software or spyware on electronic communication devices or a person's belongings without consent of all owners and primary users for purposes of monitoring or following the user.

First violation constitutes a Class 4 felony; second or subsequent conviction constitutes a Class 3 felony.

Provides exceptions for: peace officers conducting criminal investigations, parents or legal guardians monitoring minor children on owned devices, manufacturers' pre-installed software, and retail establishments tracking customer locations within their premises.
