HB4782 Summary

• Creates the Illinois Renewable Fuel Standards Act requiring all diesel fuel sold in Illinois to contain a minimum of 5% biodiesel from July 1, 2021 through June 30, 2024, increasing to 10% on July 1, 2024, subject to Department of Agriculture approval of supply and infrastructure conditions.

• Exempts from biodiesel requirements: fuel used in nuclear plant motors, railroad locomotives, U.S. Coast Guard vessels, and certain generators designed for jurisdictions without biodiesel requirements; Number 1 diesel fuel is fully exempt.

• Extends tax incentives for 100% biodiesel and biodiesel blends (10-99%) from December 31, 2023 to June 30, 2024, with additional exemption for blends containing 19-99% biodiesel extending through July 1, 2024 and beyond.

• Requires refineries and terminals to disclose biodiesel content on bills of lading and delivery tickets using volume percentage or ASTM designation.

• Directs Department of Agriculture to adopt implementing rules and begin reporting annually to the General Assembly by January 15, 2026 on implementation status, biodiesel supply, and in-state production impacts.
