IL HB4968

Amends the Wrongful Death Act (740 ILCS 180/1) to explicitly allow recovery of punitive damages in wrongful death actions.

Adds language stating that punitive damages may be recovered when a wrongful act, neglect, or default causes death and would have entitled the injured party to recover damages if death had not occurred.

Extends punitive damages availability to actions against persons, companies, and corporations that would have been liable if death had not result from the wrongful act.

Applies regardless of whether the death was caused under circumstances that constitute a felony under law.
