HB5046 Summary

• Repeals the provision in the Illinois Municipal Code that prohibited people convicted of felonies from taking the oath of office for municipal positions unless they received a pardon or restoration of rights from the Governor.

• Adds new Section 5-5-5(b-5) to the Unified Code of Corrections making people convicted of felonies while serving as public officials permanently ineligible to hold any local or state office unless they receive a pardon or restoration of rights from the Governor.

• The new felony-conviction bar for public officials applies only to felonies committed on or after the effective date of this amendatory act of the 102nd General Assembly.

• Creates a blank subsection (b-5) in the Municipal Code and redesignates subsequent subsections, with the changes declared to be clarification of existing law for all persons elected at the April 4, 2017 consolidated election and thereafter.
