Licensed nursing home facilities must offer POLST-appropriate residents (or their representatives) the opportunity to execute the Department of Public Health Uniform POLST (Physician Orders for Life-Sustaining Treatment) form

POLST-appropriate residents are defined as individuals at high risk for life-threatening clinical events due to serious life-limiting medical conditions, advanced frailty, or those with a history of emergency transfers or hospitalizations for life-threatening emergencies from chronic conditions

New POLST-appropriate residents must be offered the POLST form within 30 days of admission; existing residents must be offered the form within one year of the law's effective date

The POLST form offer must be made by qualified facility staff, community partners trained to discuss and prepare the form, or qualified health care practitioners as defined under the Health Care Surrogate Act

Execution of a POLST form cannot be required as a condition for admission to a facility or as a precondition for receiving health care services
