HB5150 Summary

• Amends Section 4-103 of the Illinois Vehicle Code to clarify that receiving, possessing, concealing, selling, disposing of, or transferring a stolen or converted vehicle or essential part constitutes a Class 2 felony regardless of whether the person stole or converted the vehicle.

• Knowledge that a vehicle or essential part is stolen or converted may be inferred from surrounding facts and circumstances that would lead a reasonable person to believe the vehicle is stolen, or from exclusive unexplained possession over the stolen vehicle or part.

• Preserves existing exemptions for vehicle repair and servicing professionals who possess manufacturer's identification number plates for the purpose of reaffixing them on damaged vehicles, provided they notify the Secretary of State and maintain required records.

• Requires vehicle owners whose vehicles are repaired under the repair professional exemption to contact the Illinois State Police Vehicle Inspection Bureau within 90 days for an inspection of the vehicle.

• Maintains that conviction for violations under this section results in a Class 2 felony charge.
