Creates the Ensuring Essential Services Act requiring contracts between the Department of Human Services and agencies providing services to individuals with developmental disabilities to include provisions assuring uninterrupted delivery of services

Mandates agencies enter into binding labor peace agreements with labor organizations representing frontline and direct support staff, prohibiting actions that would disrupt or interrupt services and establishing binding dispute resolution mechanisms

Requires the Department of Healthcare and Family Services to apply for a federal waiver or State Plan amendment within 90 days of the effective date, and the Department of Human Services to adopt implementing rules within 60 days

Establishes enforcement procedures including 30-day notice to cure compliance deficiencies, notices of nonrenewal for non-compliant agencies, and cessation of State fund distribution by the Comptroller for agencies receiving nonrenewal notices

Applies to approximately 27,000 Illinoisans receiving home and community-based support services through the waiver program, with an effective date of June 1, 2022
