IL HB5288

Amends the Juvenile Court Act of 1987 to add mandatory detention requirements for minors arrested or taken into custody for vehicular hijacking or aggravated vehicular hijacking.

Minors charged with these offenses cannot be released from custody for at least 36 hours after arrest until the court completes an assessment of whether their conduct endangers their health, person, welfare, or property, or whether their home environment poses such dangers.

If the court assessment determines the minor's conduct or home environment does pose a danger to health, person, welfare, or property, the minor must be held in custody until the disposition of their case at the adjudicatory hearing.

If the court assessment determines no such danger exists, the minor may be released from custody.
