HB5409 - Advanced Driver Assistance System Repair Act

• Creates the Advanced Driver Assistance System Repair Act defining "advanced driver assistance system" as an electronic safety system designed to support drivers and increase vehicle safety while reducing crash-related losses.

• Requires automotive glass companies and repair facilities to inform consumers before performing glass repairs whether recalibration of the advanced driver assistance system is required and to recalibrate systems to meet or exceed manufacturer specifications.

• Prohibits repair facilities from billing for services that are not performed or necessary, and restricts claims that repairs will be fully covered by insurance unless the insurer has approved and agreed to cover the full cost.

• Mandates written notice to consumers if recalibration was unsuccessful and to potential vehicle purchasers if the advanced driver assistance system is inoperable or has not been repaired or recalibrated.

• Establishes violations as unlawful practices under the Consumer Fraud Act subject to $500 civil penalties, and allows purchasers to sue for actual damages or $1,500, whichever is greater, if sellers fail to provide required notice.
