HB5415 - Eviction Moratorium Clarification Act

• Allows evictions of individuals who have not experienced substantial income loss, loss of work hours/wages, or increased out-of-pocket expenses directly related to COVID-19, even under an eviction moratorium.

• Permits evictions of tenants not making best efforts to pay rent when their financial situation allows full payment after accounting for nondiscretionary expenses (food, utilities, medical care, child care, transportation).

• Allows evictions of individuals without a rental agreement, those engaging in criminal activity on premises, threatening other residents' safety, damaging property, or substantially interfering with other tenants' use and enjoyment.

• Exempts landlords from responsibility for utility payment portions of tenants protected by eviction moratorium when monthly utility charges exceed 20% higher usage than any previous month in the prior year.

• Applies to any eviction moratorium issued by the Governor through Executive Order or legislation passed by the General Assembly, effective immediately upon enactment.
