HB5754 Summary

• Amends the Code of Criminal Procedure of 1963 to add aggravated battery to a peace officer under Section 12-3.05 of the Criminal Code of 2012 as an offense for which a judge may deny bail to a defendant.

• Allows judges to deny pretrial release for defendants charged with aggravated battery to a peace officer if the court determines by clear and convincing evidence that the defendant poses a real and present threat to the physical safety of any person.

• Requires a court hearing upon verified petition by the State, with the defendant having the right to counsel, to testify, present witnesses, and cross-examine State witnesses.

• Establishes that defendants must be brought to trial within 90 days of a detention order, excluding continuances requested by the defendant, or they shall not be denied pretrial release.

• Takes effect immediately upon becoming law.
