HB5781 Summary

• Restores Section 9.15 of the Environmental Protection Act to its form prior to P.A. 102-662, eliminating greenhouse gas permitting requirements for equipment not subject to federal regulation under 40 CFR 52.21 and Section 39.5.

• Adds provisions allowing exemption from greenhouse gas permit requirements if federal legislation, court rulings, or Presidential action deprive the EPA Administrator of authority to regulate greenhouse gases under the Clean Air Act, or if the Greenhouse Gas Tailoring Rule (75 Fed. Reg. 31514, June 3, 2010) is repealed or withdrawn.

• Permits owners or operators with existing greenhouse gas permit terms to apply for permit revision or repeal if triggering events occur, with expedited agency processing.

• Repeals Section 3.131 of the Environmental Protection Act, which previously defined "clean energy."

• Effective immediately upon becoming law.
