HB5808 Summary

• Amends the Illinois Controlled Substances Act to increase penalties for controlled substance analogs that are at least 5 times more potent than the base substance; the weight calculation is multiplied by the potency increase factor.

• Establishes mandatory sentences of 6-30 years for manufacturing or delivering carfentanil exceeding 150 milligrams in powder, blotter paper, tablet, patch, or spray form without a bright warning label stating "WARNING: CONTAINS LEVELS OF CARFENTANIL LETHAL TO HUMANS" and an accompanying rescue dose of naloxone.

• Adds 5-year mandatory sentence enhancement for fentanyl or analogs in certain forms that resemble consumer products (food branding, bright colors, cartoon characters, or FDA-approved product imitation).

• Creates new offense of "fentanyl trafficking" for knowingly bringing fentanyl, carfentanil, or fentanyl analogs into Illinois with intent to manufacture or deliver; penalties are twice the minimum and maximum terms under existing law.

• Adds Class 2 felony penalties for using cellular devices in furtherance of fentanyl trafficking and imposes additional carfentanil-specific sentencing in fentanyl trafficking cases.
